Man who adopted his wife’s last name is accused of fraud

Rules prevent men from taking wives' names. When this man tried, he was told "that only works for women"

After Lazaro Sopena and Hanh Dinh got married, Sopena decided to change his name to Lazaro Dinh to honor his wife’s Vietnamese family surname.

“It was an act of love. I have no particular emotional ties to my last name,” Dinh (né Sopena) told Reuters.

Dinh obtained a new passport and Social Security card, and changed his bank account and credit cards before going to the DMV to get a new driver’s license.

That’s when things got ridiculous.

More than a year later, he received a letter from Florida’s DMV accusing him of “obtaining a driving license by fraud,” and letting him know his license would soon be suspended.

Why? Because the state of Florida thinks that only women should change their last names after marriage.

Dinh called the DMV office in Tallahassee to correct what he thought was a mistake, and was told he had to go to court first in order to change his name legally. When he explained he was changing his name because he got married, he was told “that only works for women,” he told Reuters.

It’s not a problem unique to Florida, either. There are only nine states that currently allow a man to change his name after marriage in the same manner as a woman: California, New York, Hawaii, Louisiana, Massachusetts, Oregon, Iowa, Georgia and North Dakota. Other states require additional paperwork, months to process the request and a hefty filing fee.

But as gay marriage becomes legal in a growing number of states and feminists continue to remake traditional gender roles (!), the lack of gender neutrality around naming and licensing laws is going to remain a problem.

Dinh is currently suing the state of Florida to reinstate his wrongfully suspended license. In the meantime, he is relying on Mrs. Dinh for rides to and from work.

MIAMI (Reuters) - Florida's Department of Motor Vehicles said on Tuesday it had lifted the suspension of a South Florida man's driving license after it accused him of fraud for adopting his wife's last name.

"It was a mistake on our part," Florida DMV spokesperson Kirsten Olsen-Doolan said. "The suspension will be lifted."

The DMV stripped Boca Raton real estate investor Lazaro Dinh, 40, of his license in December after he changed his last name from Sopena to help his wife's Vietnamese family perpetuate their family surname.

His wife, Hanh Dinh, 32, has four sisters and came to the United States in 1990, after a family odyssey involving living in refugee camps and being separated from her father for seven years.

Lazaro Dinh was initially issued a new license with his wife's last name after presenting his 2011 marriage certificate at his local DMV office, just as newly married women are required to do when they adopt their husbands' names.

More than a year later, he received a letter from Florida's DMV accusing him of "obtaining a driving license by fraud" and advising him that his license would be suspended.

When he explained to the DMV that he was changing his name due to marriage, he was told "that only works for women," Dinh said. The suspension was upheld in an order issued on January 14 after a hearing in which Dinh produced his marriage certificate and a new U.S. passport with the updated name.

Olsen-Doolan said the DMV had spoken to Dinh to let him know that his license had been mistakenly suspended and "either a man or a woman can change their name" on their driving license.

"We are doing some training to make sure understand that it can be done either way," she added.

Dinh phoned Reuters to say he had been issued a new license on Tuesday after presenting his passport at a DMV office.

"I'm still bothered that it took so long and it took so much brain damage to fix. Now I want to change the law so it's clear for the next man."

Dinh's lawyer, Spencer Kuvin of Cohen & Kuvin in West Palm Beach, said that while it was unusual for a man to adopt his wife's name, Dinh's case raised important issues for the future of gay marriage.

Only a few states have made their marriage name change policy gender neutral, Kuvin said. Florida has no law, although the DMV's website does not specify gender.

According to Kuvin, nine states have laws that specifically allow a man to change his name upon marriage: California, New York, Hawaii, Louisiana, Massachusetts, Oregon, Iowa, Georgia and North Dakota.

Засудил все таки? :) Ну и хорошо. Хотя ситуация все равно идиотская, но мы-то в такой стране живем, что нам ли удивляться :D

Да, засудил :) Причем, засудил так, что теперь штату Флорида придется внести изменение в закон.

Но самое интересное тут состоит в том, что в США вопрос о смене фамилии при заключении брака увязывается с вопросом об однополых браках. Я так думаю, что это чисто англосаксонская фишка, характерная именно для англосаксонских стран?

В других странах, например, в России, муж может взять фамилию жены, или жена фамилию мужа, безо всякой гендерной разницы; и это никак с вопросом об однополых браках не увязывается.

В Японии, в которой по закону муж и жена обязательно должны иметь одну и ту же фамилию, один из супругов при заключении брака берет фамилию другого; без разницы, муж ли возьмет фамилию жены, или жена фамилию мужа.

Во Франции изменение фамилии супругов при заключении брака вообще не предусмотрено. Хотя там есть юридическая процедура, позволяющая любому гражданину взять дополнительные имя и фамилию, nom d'usage (фактически - завизированный государством псевдоним), не меняя при этом своих первоначальных имени и фамилии (что сделать намного сложнее, а раньше было вообще невозможно).
